 Please read this Orders Policy carefully before placing any order on www.schmisse.us (the “Site”). By accessing or using this Site and by completing a transaction through this Site, you agree to be bound by this Orders Policy, our Terms & Conditions, and all applicable laws and regulations. If you do not agree with these terms, please do not use this Site.

Your use of this Site, including placing an order, constitutes your waiver of any chargeback action through your credit card provider, except where prohibited by law.

By placing an order with Schmisse LLC, you represent and warrant that:

• You are at least 18 years of age.
   
• You are not prohibited by federal, state, or local law or regulation from purchasing or possessing the products offered on this Site.
   
• You will comply with all applicable federal, state, and local laws and regulations, including but not limited to California’s Firearm Industry Responsibility Act, where applicable.
   
• You will not transfer, export, sell, or otherwise dispose of any products purchased from this Site outside of the United States without first obtaining the necessary approvals from the United States government, in full compliance with U.S. export control laws.
   
• You will not supply or transfer products purchased from this Site to any person prohibited by law from possessing or receiving those products.
   
• Resellers agree to comply with all relevant state and federal laws, including California’s Firearm Industry Responsibility Act.
   
• You acknowledge and agree to be bound by Schmisse LLC’s Terms and Conditions in their entirety.

 Schmisse LLC offers a 30-day return policy for refund to the original credit card, subject to the following terms:

• You must request a Return Merchandise Authorization (RMA) number by contacting Schmisse LLC via email prior to returning any product.
   
• All returns must include the original receipt, invoice, billing address, shipping address, contact phone numbers, contact email, and the RMA number.
   
• Refunds may take up to two weeks to process, excluding transit times.
   
• Returned items must be unused and in their original sealed packaging to qualify for a refund, subject to a 15% restocking fee. Opened products may incur a 25% restocking fee or may be rejected.
   
• All original accessories, manuals, documentation, and registration materials must be included.
   
• Shipping charges are non-refundable, and you are responsible for shipping return costs.
   
• The following products are not eligible for return: custom-configured products, used products, all clothing items, special orders, and products sold “as is” or “used.”
   
• It is strongly recommended that returns are shipped using a carrier that provides tracking and full-value insurance. Schmisse LLC is not responsible for lost return shipments. Please note that USPS Priority Mail will only initiate a trace on lost packages after 30 days.

• Orders typically ship out on Fridays, subject to product availability.
   
• Standard shipping is via UPS Mail with delivery confirmation. Larger value orders may ship via FedEx or UPS with tracking and may require an adult signature upon delivery.
   
• Tracking numbers will be provided via email once your package ships.
   
• Schmisse LLC reserves the right to alter or change the shipping method selected at checkout without notice, in order to meet shipping and compliance requirements.
   
• All shipping times are estimates and are not guaranteed.

In the event a product is listed at an incorrect price or with incorrect information, Schmisse LLC reserves the right to refuse or cancel any orders placed for such products, even if your credit card has already been charged. If your card has been charged and the order is canceled, Schmisse LLC will issue a credit for the amount charged. 

All content on this Site, including text, graphics, logos, and code, is the property of www.schmisse.us and protected under United States and international copyright laws. You may use portions of this Site solely for placing orders with Schmisse LLC. Any other use without prior written consent is strictly prohibited. 

All products and materials on this Site are provided “as is,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Schmisse LLC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. 

Schmisse LLC shall not be liable for any special, consequential, or incidental damages arising from the use or inability to use the products or materials purchased from the Site, even if Schmisse LLC has been advised of the possibility of such damages. Some jurisdictions may not allow certain limitations of liability, in which case these limitations may not apply to you to the extent prohibited by law. 

You agree to indemnify, defend, and hold harmless Schmisse LLC, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Orders Policy or other Terms and Conditions, or any activity related to your account (including negligent or wrongful conduct) by you or any other person using your account. 

• This Orders Policy shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.
   
• Any dispute or claim relating to your order or use of this Site shall be resolved by binding arbitration in Berkeley County, South Carolina, under the commercial arbitration rules of the American Arbitration Association. Judgment on the award may be entered in any court of competent jurisdiction.
   
• You agree to bring any claims solely in your individual capacity and not as part of a class or representative proceeding. You expressly waive the right to file a class action or seek relief on a class basis.
   
• If any part of the arbitration or class action waiver provision is found unenforceable, the remainder shall remain enforceable to the fullest extent permitted by law.

 Schmisse LLC may deliver notices to you via email, through a general notice posted on the Site, or by other reliable means using the information you provide at checkout.

By placing an order through this Site, you expressly agree that you waive any right to initiate a chargeback with your credit card company for any transaction, except where prohibited by law. You agree to work directly with Schmisse LLC to resolve any order-related disputes.
