Using this website in any way, including executing a transaction, constitutes your agreement to these terms and conditions and a waiver of any charge-back action through your credit card provider. 

 Possession and sale/resale of products sold on this website are subject to federal, state, and local laws, including U.S. export regulations. By making a purchase from this website, you represent and warrant the following:

• I am at least 18 years of age.
   
• I am not prohibited by federal, state, or local law or regulation from purchasing or possessing a firearm or the products I am purchasing from this website.
   
• I will comply with all applicable federal, state, and local laws and regulations, including California’s Firearm Industry Responsibility Act, and will not provide any product purchased from this website to any person who is prohibited by federal, state, or local law or regulation from possessing or receiving the product.
   
• I am purchasing the product(s) for use in the U.S. only. I will not export, sell, transfer, or otherwise dispose of any product purchased from this website in any other country without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations.
   
• I understand and agree to be bound by Schmisse LLC Terms and Conditions.
   
• I agree to comply with all applicable federal, state, and local laws and regulations, including U.S. export regulations, and represent and warrant that I am at least 18 years of age and not prohibited by law from purchasing or possessing firearms or the products sold on this website. I further agree not to export, sell, transfer, or otherwise dispose of any product purchased from this website in any other country without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations.
   

Resellers of products purchased from this website further represent and warrant that they have read, understand, and will comply with all aspects of California’s Firearm Industry Responsibility Act.

 Orders for products ship via UPS Mail with delivery confirmation. Larger value orders ship via FedEx or UPS with tracking numbers and may require a signature upon delivery. You will receive tracking information by email when your package ships. Schmisse LLC reserves the right to change and alter shipping methods from those selected at checkout without notice. 

Schmisse LLC offers a 30-day return policy for credit card refunds. You must contact Schmisse LLC via email prior to returning your product to receive a Return Merchandise Authorization (RMA) number. All returns must include the original receipt and invoice, along with your billing address, shipping address, contact phone numbers, contact emails, and the RMA number. Returns and refunds may take up to two weeks, not including transit times.

Items that are unused and in their original sealed packaging can be returned for a credit card refund subject to a 15% restocking fee. If the product or packaging has been opened, the refund is subject to a 25% restocking fee or may be rejected. The return must include all accessories, manuals, documentation, and registration materials originally shipped with the product. Shipping charges and/or shipping costs are not refundable. Products not eligible for return include: custom configured products, used products, all clothing items, special orders, and items sold “as is” or “used.”

It is recommended that you return merchandise using a carrier that offers tracking numbers and full value insurance. Schmisse LLC is not responsible for any packages lost in transit. Please note that USPS Priority Mail will only initiate a trace on packages after a 30-day waiting period.

 In the event a product on www.schmisse.us is mistakenly listed at an incorrect price, www.schmisse.us reserves the right to refuse or cancel any orders placed for that product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged and your order is canceled, www.schmisse.us shall issue a credit to your credit card account in the amount of the incorrect price. 

  These terms and conditions are applicable to you upon accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by www.schmisse.us without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, Dispute Resolution, and Miscellaneous shall survive any termination. 

 www.schmisse.us may deliver notice to you by means of email, a general notice on the site, or by other reliable method to the address you have provided to www.schmisse.us. 

 Harassment in any manner or form on the site, including via email, chat, or by use of obscene or abusive language, is strictly forbidden.  In an attempt to provide increased value to our visitors, www.schmisse.us may link to sites operated by third parties. However, even if the third party is affiliated with www.schmisse.us, www.schmisse.us has no control over these linked sites, all of which have separate privacy and data collection practices independent of www.schmisse.us. These linked sites are provided only for your convenience and you access them at your own risk. Nonetheless, www.schmisse.us seeks to protect the integrity of its website and the links placed upon it and requests any feedback about the sites it links to (including if a specific link does not work). 

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.

Arbitration: You agree that any dispute or claim relating in any way to your use of this site, or to any products or services sold or distributed by Schmisse LLC or through www.schmisse.us, will be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted in Berkeley County, South Carolina, and administered by the American Arbitration Association under its commercial arbitration rules. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree to bring claims against Schmisse LLC only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You expressly waive any right to file a class action or seek relief on a class basis.

If any portion of this arbitration or class action waiver clause is found to be unenforceable, the remainder shall still be enforceable to the fullest extent permitted by law.
